Advertiser Agreement
Effective: October 9, 2026
This Advertiser Agreement (“Agreement”) is between WrongfulDeathLawyers.com (“we”) and the attorney or law firm (“Advertiser”) that applies for placement on WrongfulDeathLawyers.com or our affiliated network websites (together, the “Network”). By applying, accepting placement, or receiving inquiries, Advertiser agrees to this Agreement.
1. Nature of the service
We operate an advertising platform. Advertiser pays for advertising placement, not for the recommendation of any lawyer or for any referral. We do not analyze the legal matters of consumers, choose a particular lawyer for a consumer, or share in legal fees. Inquiries (“Leads”) submitted for a state are delivered to every participating Advertiser in good standing for that state, unless otherwise agreed in writing. We do not guarantee any number of Leads, their quality, or that any Lead will become a client.
2. Eligibility and professional responsibility
- Advertiser represents that each attorney is licensed and in good standing in every state in which Advertiser receives Leads, and will notify us within 5 days of any suspension, discipline, or change in status.
- Advertiser is solely responsible for compliance with the rules of professional conduct of each jurisdiction, including rules on advertising, solicitation, client communications, conflicts of interest, confidentiality, and fees, as well as any required filing of advertisements with state bars.
- Advertiser is solely responsible for all legal services, advice, and outcomes, and for maintaining appropriate malpractice insurance.
3. Use of Leads
- Advertiser will use Leads only to respond to the consumer's inquiry about legal representation, and will not sell, resell, or share Leads with any third party.
- Advertiser will comply with all laws governing contact with consumers, including the Telephone Consumer Protection Act, state telemarketing and “mini-TCPA” laws, CAN-SPAM, and applicable privacy laws, and will promptly honor opt-out requests.
- Advertiser will protect Lead information with reasonable security measures and treat it as confidential.
4. Fees, billing, and payment
- Fees are as stated in the plan quoted to Advertiser (for example, a flat monthly placement fee per state) and on each invoice. Pricing may change with 30 days' notice.
- Invoices are payable by the due date shown, through our payment processor. Leads are delivered only while Advertiser's account is active and paid. We may suspend placement for non-payment.
- Fees are non-refundable except as required by law or expressly agreed in writing. Fees are not contingent on, and are not a share of, any legal fee.
5. Term and termination
Placement continues month to month until either party cancels by email with notice before the next billing period. We may suspend or terminate placement immediately for breach, non-payment, loss of good standing, or conduct that could harm consumers or our reputation.
6. Advertiser content
Advertiser grants us a license to display its name, firm name, logo, and profile information on the Network. Advertiser represents that its content is truthful, not misleading, and compliant with applicable rules.
7. Disclaimers and limitation of liability
THE SERVICE IS PROVIDED “AS IS.” WE MAKE NO GUARANTEE OF LEAD VOLUME, QUALITY, OR CONVERSION. OUR TOTAL LIABILITY UNDER THIS AGREEMENT WILL NOT EXCEED THE FEES ADVERTISER PAID IN THE THREE MONTHS BEFORE THE CLAIM. NEITHER PARTY IS LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES.
8. Indemnification
Advertiser will indemnify and hold us harmless from claims arising from Advertiser's legal services, communications with consumers, violation of law or professional rules, or breach of this Agreement.
9. General
This Agreement is governed by the laws of the State of Delaware. It, together with any written pricing confirmation and our Terms of Use, is the entire agreement between the parties. Notices: legal@wrongfuldeathlawyers.com.
